KP Bar Council Announces Province-Wide Strike on Monday Against Governor's Rule in Khyber Pakhtunkhwa

PESHAWAR: The Khyber Pakhtunkhwa Bar Council has announced a province-wide strike by lawyers on Monday, October 19, declaring the imposition of governor's rule and emergency in the province unconstitutional and undemocratic, Dawn reported.

The announcement was made on Saturday by KP Bar Council (KPBC) Vice-Chairman Asfandyar Khan and Executive Committee Chairman Malik Imad Azam after a general body meeting, with the council saying lawyers across the province will stay away from court appearances on Monday.

Main News Report

Addressing a press conference in Peshawar on Saturday, the KPBC leadership unveiled a set of decisions taken by the general body against the federal government's move in the province:

  • Lawyers will observe a province-wide strike across Khyber Pakhtunkhwa on Monday, October 19, and will avoid appearing in cases.
  • The council will file a constitutional petition in the Peshawar High Court against the imposition of governor's rule and emergency.
  • A lawyers' panel has been constituted to draft the petition so the court can hear it alongside other petitions on the matter on October 20.
  • A meeting of the presidents of all district and tehsil bar associations has been convened on October 24 to decide the future course of action against the move.
  • A committee has been formed to prevent the harassment of lawyers and will take up the issue with the governor and the provincial police chief.

Background Context

The strike call follows the federal government's imposition of governor's rule and emergency in Khyber Pakhtunkhwa, a move that has sharpened the political crisis in the province. PML-N president Nawaz Sharif publicly backed the move earlier this week, as reported on this blog, while the PTI-led provincial administration has treated the step as an unconstitutional seizure of its mandate.

The bar council's intervention adds a legal-front dimension to the dispute: its constitutional petition will land before the Peshawar High Court on the same day the council says other petitions against the emergency are already listed, setting up a decisive courtroom week for the province's political future.

Reactions and Statements

KPBC Vice-Chairman Asfandyar Khan said the general body had condemned the imposition of governor's rule and emergency as an "illegal" step, insisting the legal fraternity would resist it through the courts and the strike.

He demanded that the "dysfunctional" Chief Minister Sohail Afridi and Provincial Assembly Speaker Babar Saleem Swati be produced before the court concerned or released. The council also condemned the alleged illegal detention of senior lawyer and Insaf Lawyers Forum leader Ameer Ijaz, demanding his immediate release.

Khan said the council had constituted a lawyers' panel to file the constitutional petition so that it could be heard together with other pending petitions on the emergency on October 20.

Why This News Matters

A province-wide lawyers' strike will effectively freeze the working of district courts across Khyber Pakhtunkhwa on Monday, from Peshawar to the farthest tehsils — a direct measure of the legal community's weight in the political fight over the emergency.

The constitutional petition matters even more: if the Peshawar High Court entertains the bar council's challenge alongside the petitions already listed for October 20, the judiciary could become the arena that decides whether the governor's rule stands or falls.

Future Developments

All eyes are now on the Peshawar High Court on October 20, when the bar council's petition is expected to be heard with the other challenges to the emergency. The October 24 meeting of district and tehsil bar association presidents will decide whether the lawyers' campaign escalates beyond Monday's strike.

The bar council's harassment committee is also expected to take up the detention of lawyers with the governor and the police chief in the coming days.
